GENERAL DELIVERY AND PAYMENT CONDITIONS
‘maaQstudio’
Identity:
When purchasing one or more goods, you enter into a purchase agreement with maaQstudio.
maaQstudio is part of Creative Makers Studio and is registered with the Chamber of Commerce under number 78725550.
Dutch Law:
Dutch law applies to the purchase of goods via maaQstudio. In the event of an agreement, the "distance selling" law of the Dutch Civil Code (BW7) applies. Disputes that may arise between the parties as a result of or in connection with the execution of this agreement or other agreements will first be attempted to be resolved by maaQstudio with the customer. The dispute can also be submitted to the competent court in the Netherlands.
Orders:
All goods can only be ordered via one of maaQstudio's websites at www.maaQstudio.nl. maaQstudio cannot be held liable for incorrectly entered personal details, such as names, billing addresses, shipping addresses, bank account numbers or other details such as birth dates, names, etc., for products.
Products:
The basis for most products is made of textile, cardboard, or wood, hereinafter referred to as goods or products. Prices on the website are in euros and include 21% VAT and exclude shipping costs or other additional costs. The photos shown on the website feature products that may differ from the actual design, proportions, dimensions, and colours. Sizes on the website may be rounded up or down by 0.5 cm. The colours on the website and the actual product may differ. In the case of a second order, the colours, brand, texture/colour of wood, cardboard or textile may differ from the first order.
Payment:
Payment must be made in advance by bank transfer to maaQstudio's account. This can also be done via various payment services offered. All prices include 21% VAT. An invoice will be sent by email. The customer will be informed when the payment is credited to maaQstudio's account.
Cancellation:
After ordering and payment, an order can no longer be cancelled.
Most products are custom-made and therefore cannot be cancelled.
However, products that have not been chosen with options, such as milestone cards or cases without printing, can be cancelled. Only administrative costs of €2.50 including any calculated VAT will be withheld.
Production and delivery time:
The goods are immediately adapted, designed, and produced, and delivered within approximately 5 working days after payment is credited to maaQstudio's account. Delivery times are indicative and no rights can be derived from them. maaQstudio cannot be held liable for damage or inconvenience caused by delays in any way whatsoever. The customer cannot claim compensation or cancellation of the goods or dissolution of the agreement due to delay or exceeding of the delivery time.
Shipping:
The goods are properly packaged and offered for shipment to a parcel service such as PostNL. maaQstudio cannot be held liable for damage and/or inconvenience to the customer caused by delay or exceeding of the delivery period for one or more goods, between the offering of the package by maaQstudio on the one hand and receipt by the addressee(s) on the other. The customer will be kept informed by maaQstudio during the process from purchase to offering to the parcel service. If available, the customer can request the tracking code of the shipping label by email, so that the customer can track the shipment process from dispatch to delivery. However, this only applies to parcels and not to letterbox post. The goods can be shipped "insured" upon request, at the rates applicable at that time, in addition to the normal shipping costs, plus any additional administration costs. The goods can be sent by "express courier" upon request, at the rates applicable at that time, plus any additional administration costs.
Delivery and receipt:
Upon receipt, the goods must be checked for damage to the packaging or the goods themselves. If visible damage to the packaging or goods is found, this must be reported immediately in writing to the courier. If no report is made, no claim can be made on the insurance and the warranty will lapse. Upon receipt, the goods must be checked for quantity and color before being unpacked and distributed. If the goods are not in accordance with the order, after discovery was reasonably possible, the customer must notify maaQstudio in writing within 7 days of delivery. maaQstudio has the option of replacing the goods with the correct goods upon return, or refunding the invoice value thereof. If the goods or parts thereof have been used or are not found with the returned goods, this constitutes acceptance of the goods and these goods will not be accepted and taken back by maaQstudio and the warranty will lapse. The goods will then be sent again, after payment of the then current shipping rates and deduction of the shipping costs paid by the customer ("the shipping costs paid by the customer" refers to the part as described in the "Return shipment" chapter).
Return shipment:
Goods can only be returned as described in the chapter 'Delivery and receipt'. If the customer returns the Product, it must be in its original packaging or in another sturdy packaging, unopened and without signs of use. If the products are damaged when received by maaQstudio due to incorrect packaging of the goods, other than through the fault of the parcel service, the warranty will be void. Furthermore, the responsibility for shipping, regarding damage, theft or loss, falls under the responsibility of the sender. The costs of returning incorrectly delivered goods will be borne by maaQstudio. In this case, a shipping label provided by maaQstudio to the customer must be used. If the customer chooses another courier, the costs of the return shipment will be borne by the sender.
However, if unadapted, non-personalized items are returned, or if a return has been agreed upon with maaQstudio, the return costs will be borne by the customer.
Refunds for returned items will be made within 14 days of receipt of the goods in good condition by maaQstudio.
Use of goods:
maaQstudio cannot be held liable for incorrect use of the goods. For textiles, washing instructions must be followed, cases are not indestructible, so they should be used with some care. Wooden objects may contain splinters, so be careful with them. Rattles and other baby toys are safe for all ages, but be careful not to leave babies unattended with such items.
Changes to the purchase agreement:
maaQstudio reserves the right, in case of force majeure, to suspend or dissolve the purchase agreement, without judicial intervention and without any form of compensation, with the exception of the refund of the goods already paid for by the customer. Force majeure can be understood as any shortcoming that cannot be attributed to maaQstudio. The customer can no longer change the purchase agreement once the goods have been ordered and are in production.
Changes to the General Delivery and Payment Conditions:
maaQstudio may amend the "GENERAL DELIVERY AND PAYMENT CONDITIONS" in the interim, with the exception of the statutory provisions of the Dutch Civil Code. The new conditions will not apply to current orders, but only to orders placed on the day of the published change.
Liability:
maaQstudio is, with the exception of intent or gross negligence, never liable for any accidents, direct or indirect material or immaterial damage, death, injury, harm, loss, damage or theft, damage to objects, machines, installations and buildings, business stoppage, delay and/or disruption, delay in construction flow, environmental damage or any other business or personal damage, as well as consequential damage suffered by the customer, client, user or third parties.
Privacy:
maaQstudio is committed to protecting personal data. Your personal data will be included in maaQstudio's customer database. The personal data known to maaQstudio will not be provided to third parties. The personal data is for administrative use, such as: the purchase agreement, collection of due payments, managing customer relationships, carrying out marketing activities, fraud prevention and compliance with legal obligations.
